Pokki Content Policies

THE POLICIES LISTED BELOW (THE “POKKI CONTENT POLICIES”) APPLY TO YOUR POKKI, WHETHER APPROVED AND DISTRIBUTED BY SWEETLABS, INC. (“SWEETLABS”) THROUGH THE POKKI APP STORE OR VIA SWEETLABS’ WEBSITES OR SOFTWARE ADVERTISER NETWORK, OR VIA YOUR OWN WEBSITE OR OTHER CHANNELS OF DISTRIBUTION.

THESE POKKI CONTENT POLICIES ARE IN ADDITIONTO ANY TERMS AND CONDITIONS AS SET FORTH IN THE POKKI DEVELOPER DISTRIBUTION AGREEMENT, AND ANY DEFINED TERMS IN THESE POKKI CONTENT POLICIES HAVE THE SAME MEANING AS IN THAT AGREEMENT. PLEASE NOTE THAT REGARDLESS OF YOUR COMPLIANCE WITH THESE POKKI CONTENT POLICIES, YOUR USE OR DISTRIBUTION OF YOUR POKKI ARE CONDITIONED UPON YOUR SUBMISSION OF YOUR POKKI FOR REVIEW AND APPROVAL BY SWEETLABS AS SET FORTH AT http://developers.pokki.com.

1. Introduction

a. The Pokki App Store (the “Pokki App Store”) is a publicly available site on which developers may distribute web application product that they have developed using or incorporating the Pokki SDK, or that is designed to run on the Pokki web application platform (each such application a “Pokki”).

b. Distribution of all Pokkies is subject to review and approval by SweetLabs. To ensure a continuing robust Pokki App Store, and to provide a fantastic Pokki user experience that makes users happy, We (SweetLabs) have created these Content Policies as guidelines to assist developers in creating Pokkies for submission to the Pokki App Store, as well as to provide continuing guidance with respect to Pokkies already being distributed, whether through the Pokki App Store or through your own website.

c. These Content Policies apply to any websites or content your Pokki displays, access or links to, including any ads it shows to users, any user-generated content it hosts or links to, or any updates or pages it displays. In addition to complying with these Content Policies, your Pokki, and any content your Pokki access or displays, must be reviewed for approval by SweetLabs as set forth at http://developers.pokki.com.

2. Content Policies

a. Sexually Explicit Material: We don't allow content that contains nudity, graphic sex acts, or sexually explicit material. SweetLabs has a zero-tolerance policy against child pornography. If we become aware of content with child pornography, we will report it to the appropriate authorities and delete the accounts of those involved with the distribution.

b. Violence and Bullying: Depictions of gratuitous violence are not allowed. Pokkies should not contain materials that threaten, harass or bully other users.

c. Hate Speech: We don't allow the promotion of hatred toward groups of people based on their race or ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation/gender identity.

d. Impersonation or Deceptive Behavior: Don't pretend to be someone else, and don't represent that your app is authorized by or produced by another company or organization if that is not the case. Pokkies or the ads they contain also must not mimic functionality or warnings from a user’s operating system or other applications. You should not divert users or provide links to any other site that mimics Pokki App Market or passes itself off as the Pokki App Market.

e. Personal and Confidential Information: We don't allow unauthorized publishing of people's private and confidential information, such as credit card numbers, Social Security numbers, driver's and other license numbers, or any other information that is not publicly accessible.

f. Intellectual Property: Don’t infringe on the intellectual property rights of others, including patent, trademark, trade secret, copyright, and other proprietary rights. We will respond to clear notices of alleged copyright infringement. For more information or to file a DMCA request, please visit our copyright procedures.

g. Illegal Activities: Keep it legal. Don't engage in unlawful activities on this product.

h. Gambling: We don’t allow content or services that facilitate online gambling, including but not limited to, online casinos, sports betting and lotteries.

i. Malicious Products: Don't transmit viruses, worms, defects, Trojan horses, malware, or any other items of that may harm user devices or personal data. We don't allow content that harms or interferes with the operation of the networks, servers, or other infrastructure of SweetLabs or any third-parties. Spyware, malicious scripts and password phishing scams are also prohibited on Pokki App Store.

j. Network Usage and Terms: Pokkies must not create unpredictable network usage that has an adverse impact on a user system or network. Pokkies may not violate any Pokki.com terms of use.

k. Access to other Websites: Do not submit or create Pokkies where the primary functionality is to link to a website or sites, or a view or page of a website, that is not owned by you (unless you have permission from the website owner to do so).

3. Enforcement. In the event your Pokki is removed from the Pokki App Store, you will receive an email notification regarding such removal. You may contact us at [email protected] regarding any such removal. Serious or repeated violations of the Pokki Developer Distribution Agreement or this Pokki Content Policy, including repeated infringement of intellectual property rights, will result in termination of your agreement and account with SweetLabs.
